安徽省濉溪縣人民法院 民 事 判 決 書 （2016）皖0621民初1501號 原告：濉溪縣鑫順商貿有限公司，住所地安徽省濉溪縣。 法定代表人：王奇志，該公司董事長。 被告：安徽寶迪肉類食品有限公司，住所地安徽省淮北市烈山區。 法定代表人：高振宏，該公司董事長兼總經理。 委託代理人：黃德光，該公司法律顧問。 原告濉溪縣鑫順商貿有限公司（簡稱鑫順公司）與被告安徽寶迪肉類食品有限公司（簡稱寶迪公司）買賣合同糾紛一案，於2016年4月14日向本院起訴。本院受理後，依法由審判員蔡淑華適用簡易程序，於2016年5月16日公開開庭進行了審理。鑫順公司的法定代表人王奇志、寶迪公司的委託代理人黃德光到庭參加訴訟。本案現已審理終結。 鑫順公司訴稱：雙方經過電話聯系商定買賣液氨事宜，鑫順公司履行了交貨義務，並開具了增值稅發票。寶迪公司付款15000元後，下欠25768元貨款至今未付。請求法院判令寶迪公司償還貨款25768元，並支付自起訴之日至欠款還清之日的利息；訴訟費用由寶迪公司負擔。 寶迪公司辯稱：因客戶欠寶迪公司的貨款，導致公司資金緊張無錢還款，願意用沈陽市的商鋪抵償。 經審理查明：寶迪公司因生產需要使用液氨，與鑫順公司電話聯系，雙方協商買賣事宜，寶迪公司購買鑫順公司40768元的液氨。後鑫順公司履行了交貨義務，並開具了相應的增值稅發票交給寶迪公司。寶迪公司付款15000元後，下欠25768元貨款經催要至今未付。 上述事實，有當事人陳述、欠條等證據在卷佐證。 本院認為：鑫順公司與寶迪公司之間買賣合同關系成立。鑫順公司已將液氨交給寶迪公司使用，寶迪公司應按照約定支付貨款，雙方債權債務關系明確，寶迪公司應遵守誠實信用原則支付貨款25768元。依照《中華人民共和國合同法》第一百零七條、第一百三十條、第一百五十九條、第一百六十一條、《最高人民法院關於審理買賣合同糾紛案件適用法律問題的解釋》第二十四條之規定，判決如下： 被告安徽寶迪肉類食品有限公司於本判決生效後10日內，償還原告濉溪縣鑫順商貿有限公司貨款25768元及相應利息（利息按中國人民銀行同期同類人民幣貸款基準利率自2016年4月14日起計算至貨款還清之日止）。 如果未按本判決指定的期間履行給付金錢義務，應當依照《中華人民共和國民事訴訟法》第二百五十三條之規定，加倍支付遲延履行期間的債務利息。 案件受理費444元，減半收取222元，由被告安徽寶迪肉類食品有限公司負擔。 如不服本判決，可在判決書送達之日起十五日內，向本院遞交上訴狀，並按對方當事人的人數提出副本，上訴於安徽省淮北市中級人民法院。 審判員蔡淑華 二〇一六年五月二十三日 書記員戚肖雯
